COURT CASE

Today our case for grant of pension @ 50% of LPD for all BSNL pensioners  retired prior to 1.1.2006 was listed as Case No. 50. But though some  other cases were heard,  our case was far below and hence not taken up  for hearing!
Advocate Sri. Sreeraj intimates that he will inform us the next date. The other case for 78.2 arrears from 1.1.2007 is listed for 21st instant.  Cannot say what will happen on that day.

There is a very strong feeling among all the Pensioners throughout the country that pension is to be exempted from income tax for the following reasons

Supremecourt time and again declared in various judgements that pension is akin to property rights

NDA government led by Shri Modiji abolished wealth tax in 2015-16 budget foregoing more than 1,000 crore rupees to the exchequer. Earlier it was only 1%  above Rs.30 lakhs.

In 2017-18 budget income tax to corporates was reduced from 30% - 25%  whose turnover was less than Rs. 50 crore. By this way Government lost a revenue of Rs.7000 crores. It is proposed to increase it to Rs.250 crores. It was told that it was done with a view to increase the employment generation.

Total pension expenditure for the Central government in 2017-18 was Rs.1,31,201 crores which include other retirement benefits also.  Actual pension expenditure might be Rs.80,000 crores. On an average if 10 percent is taken if the government abolishes tax on pension the government may forego only Rs.8000 crores.

Pension amount is spent on consumer goods which generates demand and inturn helps for more production and generate more employment.

Savings of pensioners in banks and post offices helps investment for the industries which inturn helps employment generation.

If NDA government  abolish income tax on pension it shall earn the goodwill of nearly 15 crore people consisting pensioners and their family members.

We request serious consideration of the above proposal.

P Gangadhara Rao,
GS, AIBSNLPWA Bangalore.

THE COURT CASES

As all of you know we had filed two cases before Ernakulam bench of Central Administrative Tribunal.

1. to get pension arrears with 78.2% IDA from 1-1-2007 instead of 10-6-2013, as granted. (Arrears Case in short)
2. to get pension refixed @ 50% of Last Pay Dawn for all BSNL Pensioners retired prior to 1-1-2006. (LPD case in short)
After many postponement again and again, The Arrears Case (338/18) is listed for 18-6-2019. We hope it will be taken up for hearing.
The LPD case (346/18) was also postponed again and again and finally listed for 7-6-2019. One day before that date it was re-posted for 12-6-2019 by notification. Again on 11-6-2019 it is once again posted to 21-6-2019 by notification.
Earlier there was only one judge. Now both judges are available. We hope that the Tribunal will take up the cases for hearing.

ANOMALY CASE: On 16-12-2016, CAT Principal bench pronounced its judgement in our favour in the anomaly case . Unfortunately, instead of respecting the court order, DoT preferred to file appeal in High Court. The high court of Delhi gave a very long gap to consider the case. Now, it is posted to 18, July 2019. More than 4200 BSNL employees retired from October 2000 to July 2001 have suffered huge loss in their pension due to the anomaly. Half of them have already left this earth. Remaining people are 79 years old. They are waiting for the justice.
